Acceptance of Terms

By downloading, installing, or using the Hiveger application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App. The App is provided by Hiveger ("we", "our", or "us").

Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by updating the date at the top of these Terms and, in some cases, provide additional notice (such as adding a statement to our website or providing in-App notification). Your continued use of the App after such changes indicates your acceptance of the new Terms.

Account Registration and Security

To use certain features of the App, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to terminate or suspend your account at any time for any reason.

Your use of the App and any data you provide is subject to our Privacy Policy, which is incorporated into these Terms. By using the App, you consent to all actions we take with respect to your data consistent with our Privacy Policy.

Subscription and Payments

Some features of the App may require a subscription. By subscribing to such features and providing payment information, you agree to pay all charges at the prices specified for your subscription. We may adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole discretion. Any price changes will take effect following notice to you.

Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. We do not warrant that the App will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HIVEGER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THIS APP.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Hiveger is established, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
